This privacy policy outlines the policies and procedures followed by PCT for information collected, how we use it and the steps we take to ensure that it is protected (herein the "Privacy Policy"). Users can access the PCT software solutions, website, APIs, third-party information and other services collectively ("Services") an online solution intended for worldwide use for recording, managing and sharing of farming related activities. The Services are provided to you by Precision Cropping Technologies Pty Ltd ("us" or "we" or "our"), in connection with our partners, service providers, sponsors or other affiliates.

This Privacy Policy governs your access of the Services, regardless of how you access it, and by using our Services you consent to the collection, transfer, processing, storage, disclosure and other uses described in this Privacy Policy. All of the different forms of data, information, photos, questions, messages, comments, feedback, ideas, notes and other materials (collectively "Content").

Please read this Privacy Policy carefully. Your use of any part of the Services will constitute your agreement to this Privacy Policy. If you cannot agree with the terms and conditions of this Privacy Policy, please do not use the Services. This Privacy Policy does not cover information collected elsewhere, including, without limitation to offline or on sites linked to through the Services.

In addition to reviewing this Privacy Policy, please read our Terms and Conditions. Your use of the Services constitutes agreement to the Terms and Conditions as well.

We reserve the right to modify this Privacy Policy at any time, so please review it frequently. If we make material changes to this Privacy Policy or if we change our email practices, we will notify you here, by email, or by means of a notice on our home page.

Information we collect from you

In order for PCT to provide you with a comprehensive service we ask for your personal data, such as your name, email address, location, farming interests, etc.

To fully utilise our Services we also encourage you to upload information about your activities such as GPS mapping data, types of farming equipment used, field locations and boundaries, activity type, date, time, scouting records etc. All the above mentioned data will be available to you at www.pct-ag.com (the "Site").

All upgrades are handled from within the PCT application (hereinafter the "App") on your personal computer, laptop or tablet and therefore any attempt to solicit your credit card details outside of the PCT billing environment should be reported to your internet service provider as suspicious.

You may ask us to import additional data by giving us access to your third-party Services so additional data can be made available through the App or Site. You may also provide us with your contacts’ email addresses when sharing activities or scouting files with them. We may also receive Personal Information (for example, your email address) through other users, for example if they have tried to share something with you or tried to refer PCT to you.

How your information is used

PCT does not share, rent or sell information concerning PCT’s members or other users of its Site to third-parties in ways other than disclosed in this Privacy Policy. To use the Services, you must first complete the Sign Up process and agree to our Terms and Conditions. During registration you will be required to provide personal information such as your name and email address.

There are several other opportunities on the Services for you to share information about your farm setup and farming activities with PCT. If you choose to share any information with PCT, we may store it and use it for internal research and marketing purposes, including emailing you with special promotions and other programs of interest. You may remove your name from our email list by unsubscribing via the links provided.

You may decide to send PCT personally identifying information in an email message which might contain information or inquiries about PCT’s products or Services. PCT will use this information to identify you as a PCT member and to respond to the electronic mail. PCT will only use the information obtained to resolve the issue identified in the email. PCT never sells email addresses.

PCT will only share your personal information with third-parties if:

PCT has your consent;

PCT determines that it is required to do so by law; such as in response to a court order or subpoena;

PCT finds that you are in breach of its terms and conditions or any of its policies or usage guidelines for specific products or Services;

it is necessary in PCT’s opinion to do so to prevent, investigate, detect or prosecute criminal offenses or attacks on the technical integrity of the Services or PCT’s network; or

it is necessary in PCT’s opinion to do so to protect the rights, property, or safety of PCT or its employees, the users of its Site, or the public.

Information about you and your use of the Services may be aggregated with other information collected on the Services or otherwise used in ways that do not personally identify you or constitute personally identifiable information. This type of aggregated or statistical information may be used by us to improve the quality of the Services or for other purposes that we may deem appropriate.

How your information is protected

We maintain data handling and storage practices and procedures that are designed to ensure the integrity and confidentiality of the personally identifiable information and email addresses submitted to us, both during transmission and once we receive it. Current Internet security methods and technologies are used to prevent unauthorized access, maintain data accuracy, and ensure correct use of information. No method of transmission over the Internet or method of electronic storage is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

To help ensure that these measures are effective in preventing unauthorized access to your private information, you should be aware of the security features available to you through your browser. You should use a security-enabled browser to submit your sensitive information and other personal information at the Services. Please note: If you do not use a SSL-capable browser, you are at risk for having data intercepted. PCT will not be responsible for any compromise of data that is intercepted due to your use of an unsecured browser.

Most browsers have the ability to notify you if you change between secure and insecure communications, receive invalid Services identification information for the Services you are communicating with, or send information over an unsecured connection. PCT recommends that you enable these browser functions to help ensure that your communications are secure. You can also monitor the URL of the Services you are visiting (secure URLs begin with https:// rather than the normal http://), along with the security symbol of your browser to help identify when you are communicating with a secure server. You can also view the details of the security certificate of the Services to which you are connected. PCT encourages you to use this to check the validity of any Services you connect to using secure communications.

When we may share your information

The information we gather is used to create and maintain your farming activities. We also use the information that we gather to target Content on our Site to more closely match your interests and, if you have selected to receive email communication from us such as Monthly Activity Summary Reports, targeted advertising messages may be incorporated that are appropriate to your needs.

When you use the Services, the personal information you provide will be shared with the third-parties you designate for access to such information including other web sites, web services or APIs if you authorise such access using your user login credentials for that third-party.

Certain portions of the information you provide to us also may be displayed in your public profile. As an essential element of the Services we offer, most of the personal information you explicitly provide to us when you register or update your profile is displayed on your public profile. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so it is very important that you do not put personally identifiable or other private information in your posts. Once you have posted information publicly, while you will still be able to edit and delete it on the Site, you will not be able to edit or delete such information cached, collected, and stored elsewhere by others (e.g. search engines).

In general, most of your farming related information, such as field activities and scouting records, is displayed only to other users of the Services to whom you have specifically connected as a Linked Account. You can change your privacy settings to designate which types of information are shared and with whom by visiting the Privacy Settings page.

From time to time, we also may share general information about our Site, users, and visitors such as the number of visitors, aggregate and/or non-personally identifiable demographic and activity data, etc with third-parties.

Other than as set out above, you will also have the choice to authorize third-party websites and mobile applications to access your farming information as part of their service to you. The reason for allowing this authorization is to make it easier for you to access your farming information on a mobile device and to more easily incorporate your farming information with other third-parties authorized by you. We will not share, sell, rent, or trade your personal information with third-parties other than as described within this Privacy Policy.

If we are involved in a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction, but we will notify you (for example, via email and/or a prominent notice on our Site) of any change in control or use of your Personal Information or Files, or if either become subject to a different Privacy Policy. We will also notify you of choices you may have regarding the information.

We may disclose your non-private, aggregated, or otherwise non-personal information, such as usage statistics of our Services.

Information sharing and disclosure

PCT does not sell, rent or share Content or Personal Information or without your consent (as appropriate), except as follows:

Developers and Beta Testers

We will display authorised Personal Information in each Developer and Beta Tester’s profile page and elsewhere on the Site according to the preferences set in each account. Any information a Developer or Beta Tester chooses to provide should reflect how much it wants other users to know about it. We recommend that each Developer or Beta Tester guard its anonymity and sensitive information, and we encourage Developers and Beta Testers to think carefully about what information about themselves they disclose in their profile pages. Developers and Beta Testers can review and revise their profile information at any time.

Service Providers, Business Partners and Others

We may employ third-party companies and individuals to facilitate our Services, to provide the Services on our behalf, to perform Site-related Services (including but not limited to data storage, maintenance services, database management, web analytics, payment processing, and improvement of the Site’s features) or to assist us in analysing how the Site and Services are used. These third-parties have access to your Content and Personal Information solely for purposes of performing these tasks on our behalf. We intend to make reasonable efforts to ensure that these third-parties execute industry standard confidentiality agreements to protect Content and Personal Information.

Compliance with Laws and Law Enforcement

PCT cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any Site or Personal Information to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of PCT or a third-party, to protect the safety of the public or any person, or to prevent or stop any activity we may consider to be, or to pose a risk of being, illegal, unethical, inappropriate or legally actionable.

What if information I have previously submitted has changed?

If you need to correct, amend or delete submitted information that is inaccurate please contact us. We will respond to your email request within 30 days. In addition, you may correct, amend or delete submitted information that is inaccurate by visiting the App or the Site.

Communication you may receive from us

We think that you may benefit from a more personalized experience when we know more about you and your farming activities. However, you can limit the information you provide to us, and you can limit the communications that we send to you.

You can manage your communications by doing any of the following:

following the instructions in our emails on how to unsubscribe yourself from our email list; or

You may also subscribe or unsubscribe for certain communications from us as explained in more detail below and in the Terms and Conditions. Registration and login are required to access these account settings.

Special offers and updates

We send all new members a welcoming email to verify password and username. Established members will occasionally receive information on products, Services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see unsubscribe link attached with these communications.

Services announcements

On rare occasions it is necessary to send out a strictly Services related announcement. For instance, if our Service are temporarily unavailable for maintenance we might send users an email. Generally, users may not unsubscribe from these communications, as they are not promotional in nature.

Customer service

We communicate with users on a regular basis to provide requested Services and in regards to issues relating to their account we reply via email or phone, in accordance with the users wishes.

Cookies

The Site uses session cookies to keep you logged in within same browser session. A cookie is a unique identifier sent to your computer by a web server and stored on your computer's hard drive. A cookie lets a computer server identify your computer. A cookie is what allows many sites to greet you upon every return with a personalized message even before you actively login.

We use cookies to improve your user experience and reduce the time it takes for you to view your data. Our cookies do not include any personal information, but they do help us track which of our Site pages are visited and what Services are most often used. You may choose not to receive a cookie file by enabling your web browser to refuse cookies or to prompt you before accepting a cookie. Please be aware, however, that by refusing to accept cookies, you will be unable to access a significant portion of the Site and Services.

PCT uses cookies to enhance your use of the Site. Besides PCT cookies, the Site sets persistent cookies from Google Analytics. You can turn off all cookies, in case you prefer not to receive them.

Third-Party cookies

Our Privacy Policy does not cover the use of cookies by our partners and service providers, or by third-party advertisers and ad networks. We do not have access or control over these cookies. Our partners and service providers use session ID cookies to make it easier for you to navigate our Site.

Third-Party advertising

From time to time, we may use one or more third-party advertising companies or ad networks to serve advertising on our behalf, or on behalf of third-parties. Through the use of technology devices commonly referred to as cookies and action tags, a third-party ad-serving company can measure the effectiveness of our ads, including third-party ads displayed on our Site. We do not have access to a third-party ad server's cookies, (which are similar to our own cookies) or other features that advertisers and third-party websites may use.

Links to Third-Parties

For your convenience and to improve the usage of the Site we insert links to third-party websites, for which this Privacy Policy does not apply. These links take you outside our Service and off the Site and are beyond our control. This includes links to third-party websites that may use PCT's logos as part of a co-branding agreement.

We encourage you to read the privacy statements of every website you visit. This Privacy Policy applies solely to information collected by us through the Site and does not apply to any third-party websites you may visit, including through links within third-party ads displayed on our Site.

When we do link to a third-party website, this does not automatically imply that PCT endorses that website, its contents or products.

Surveys

We may occasionally offer Site visitors an opportunity to participate in a survey or contest. Information we collect for such a survey or contest will be subject to the same protection as the information we generally collect from our users.

Testimonials and user feedback

We sometimes receive testimonials and comments from users who have had positive experiences with our Services. We occasionally publish such Content. When we publish this Content, we may identify our users by their first and last name and may also indicate their home city. We do obtain the users consent prior to posting their name along with their testimonial.

International users - Applicable Law

We collect, process, store, disclose, and dispose of personal information that you submit to us in accordance with applicable United States law. Please note that the personal information you submit to our Services will be transferred to the United States to be processed by us in order to provide this Site and the Services to you or for such other purposes as set forth in this Privacy Policy. If you are not a resident of the United States, you acknowledge and agree that we may collect, process, use, and store your personal information, as discussed in this Privacy Policy, outside your resident jurisdiction, including in the United States.

Data security

The Site takes every precaution to protect our users’ information. When users submit sensitive information via the Site, their information is protected both online and off-line.

All of our users’ information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job (for example a customer service representative) are granted access to personally identifiable information. ALL employees are kept up-to-date on our security and privacy practices. Every quarter, as well as any time new policies are added, our employees are notified and/or reminded about the importance we place on privacy, and what they can do to ensure our users’ information is protected. Finally, the servers that store personally identifiable information are in a secure environment.

If you are not a resident of the United States, you understand and agree that PCT stores and processes your information on computers located in the United States, and by providing any data to us, you consent to the transfer of such information to the United States and the application of the laws of the United States.

PCT is very concerned with safeguarding and protecting all Content and Personal Information. We employ reasonable measures and security designed to protect your information from unauthorized access, alteration, disclosure or destruction. These measures include encrypting sensitive information using a Secure Sockets Layer (SSL) and storing information behind a firewall. However, we cannot ensure, guarantee or warrant the security of all information held, especially against third-party attacks or intrusions. Therefore all information provided to PCT is provided at the Developer, Beta Tester or User’s risk.

Data retention

We will retain your information for as long as your account is active or as needed to provide you the Services. If you wish to cancel your account or request that we no longer use your information to provide you Services, you may delete your account. We may retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Consistent with these requirements, we will try to delete your information quickly upon request. Please note, however, that there might be latency in deleting information from our servers and backed-up versions might exist after deletion. In addition, we do not delete from our servers files that you have in common with other users.

Unsubscribe, delete or modify Personal Information

You may cancel your registration to the Services with PCT at any time, and you can choose to unsubscribe from receiving any emails from us. Additionally you can choose to have all your personal data deleted from our database.

If you choose to stop receiving emails from us, please follow the unsubscribe instructions within each email communication. PCT will not provide or share any mailing lists or other information about you to another company or service for promotional purposes. Any Services related emails (to confirm a purchase or Site maintenance, etc.) generally do not offer an option to unsubscribe as they are necessary to provide the Services you requested.

In some cases we may retain copies of your information if required by law. For questions about your Personal Information on our Services, please contact us. We will respond to your inquiry within 30 days.

If there are fraudulent charges on my credit card, what should I do?

If you believe that there are fraudulent charges on your account that are the result of the use of your credit card at the Services then please contact your credit card provider immediately.

You should carefully review security, privacy and billing policies of any third-party sites accessible from the Services. Other sites accessible through the Services have their own policies and data collection, use, billing mechanisms and disclosure practices. Please consult each Service’s policies and practice. PCT is not responsible for the policies or practices of third-parties. This Privacy Policy does not cover the information practices of those websites linked from the Services.

Updates to this Privacy Policy

PCT reserves the right to modify this Privacy Policy at any time. If we make any changes to this Policy, we will change the "Last Updated" date above. If you use our Site after we post these changes, this indicates your acceptance of them.

If, however, we are going to use users’ personally identifiable information in a manner different from that stated at the time of collection we will notify users via email.

Legal disclaimer

Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Site.

While PCT continues to work hard to protect your personal information, no data transmission over the Internet can be guaranteed to be absolutely secure, and we cannot ensure or warrant the security of any information you transmit via the Services. Transmitting personal information is done at your own risk.
